What you can do today for your loved ones

What will happen if you don't wake up tomorrow morning?
Money, house, car...everything you own in your name may go to a legal process called probate, and your state will decide who gets your assets. If there's a dispute, the state will decide on your minor children's custody as well.
Even if there's only one heir, therefore, no potential dispute, it's better to avoid a probate which is a lengthy and costly legal process. By doing following several things today, you can save your loved ones money and time, and more importantly, largely prevent potential headaches and disputes among your loved ones after you're gone.

  • Unless you have a joint account, assign TOD (transfer on death) on your bank accounts and investment accounts. This can avoid probate and it is free.
  • Designate primary and secondary beneficiaries on your life insurance and retirement accounts. This can avoid probate and it is free.
  • On your real estate (home) and personal property (car, boat etc.), add whoever you wish to give your properties to at your death on the title. This can avoid probate and it is free. Don't forget to update if situations change.
  •  Prepare a will that grants custody of your minor children, and designate persons for your residual assets. Like beneficiary designation in the above cases, a will needs to be updated as situations change. But remember, other than child custody, people can contest your will, meaning your wishes may or may not be realized in the end. This does NOT avoid probate, but may be free if drafted by yourself, but consulting a lawyer is recommended. If you draft a will by yourself, make sure to let other people know of its existence. That's because if no one knows of it after your death, your will becomes useless.
  • Finally, draft a living will and talk to your loved ones about your last medical treatment wishes. And talk to them about your funeral arrangements. These are not easy conversations, but need to be had and will be greatly appreciated later by your loved ones.

당신의 돈, 집, 차...당신 이름으로 등록돼 있는 모든 재산은 주정부에서 관리하는 프로베잇 (probate) 과정을 거쳐야 할지도 모르며, 그렇다면 주정부가 당신 재산의 상속권자를 결정할것이다. 어린 아이의 양육권에도 분쟁의 여지가 있으면 그것 또한 주정부가 결정할 것이다.  만약 상속권자가 단 한사람 뿐으로 분쟁의 여지가 없다 하여도, 법적 소유권 이전을 위한 프로베잇 (probate)은 시간과 비용이 꽤 듦으로, 이 과정을 최대한 피하는것이 좋다. 당신이 오늘 해 놓음으로써, 남아 있는 사랑하는 가족들의 돈과 시간, 그리고 무엇 보다 잠재적인 다른 문제 및 가족간 분쟁을 어느정도 예방할 수 있는 몇가지를 소개한다.

  • 어린 자녀가 있다면 양육권자를 지정하고 나머지 재산을 상속할 수 있는 유서를 작성하라. 위의 계좌들에 대한 상속인도 마찬가지지만, 상황이 변하면 유서도 그에 맞게 고쳐져야 한다. 그렇지만, 어린 자녀의 양육권자를 제외한 나머지 유서에 작성된 상속 부분은 당신의 유지에 반대하는 다른 사람들이 이의를 제기하며 법적으로 소송을 할 수 있고, 그러면 당신의 유지가 지켜지지 않을 수 도 있다. 유서는 프로베잇과정을 피할 수 없고, 당신이 직접 작성하면 비용이 들지는 않지만, 변호사와 상담할것을 권장한다. 만약 변호사의 도움 없이 당신이 혼자 작성한다면, 그 존재를 다른 사람들에게 알려야 한다. 왜냐면 당신의 사 후, 아무도 유서가 있는지 모른다면 무용지물이 되기 때문이다.
  • 끝으로, living will을 작성하고 가족들에게 당신이 마지막길에 원하는 (또는 원하지 않는) 의료 서비스에 대한 의견을 피력하라. 그리고 당신의 장례식 절차에 대해서도 얘기하라. 이런것들은 상당히 힘든 대화 이지만, 반드시 필요하며, 나중에 당신의 가족이 당신에게 무척 고마워할 일 이다.
